A worker, employed by TMI Contracting and Equipment Rental Ltd. of Richmond Hill, Ontario, was fatally struck by a dump truck at a landfill site. The employer failed to protect a worker by ensuring the safety measures and procedures required for a signaller were carried out, as outlined in 106(3) of Regulation 213/91 of the Occupational Health and Safety Act.

The company involved was Eastway Tank, Pump and Meter Limited, a company that manufactured and serviced tank trucks, from Nepean, Ontario. The company’s director was Neil Greene.

(the Company) failed to ensure that machinery being operated was equipped with a guard or other device to prevent access to moving parts, as prescribed by section 24 of Ontario Reg. 851, Industrial Establishments. This is contrary to section 25(1)(c) of the Occupational Health and Safety Act.
