A worker, employed by Pigments Services Canada Inc., operating as Monteith, of Toronto, Ontario, a manufacturer of paint and specialty coatings, was fatally injured while operating a paint mixing machine. Pigments Services Canada Inc. failed to ensure that the measures and procedures prescribed by section 24 of Ontario Regulation 851/90 were carried out at the workplace, contrary to sections 25(1)(c) and 66(1) of the Occupational Health and Safety Act.

The company failed, as an employer, to provide information, instruction and supervision to a worker to protect the health or safety of the worker, contrary to section 25(2)(a) of the Occupational Health and Safety Act.

By not ensuring the equipment was properly guarded, NuStef Baking Ltd. failed to ensure that the measures and procedures prescribed by section 25 of Ontario Regulation 851/90 were carried out at the workplace, contrary to sections 25(1)(c) of the Occupational Health and Safety Act.
